Contracts for Vending Business…

Hi,

My name is Max Woody and I’ve been in the Vending Machine business for over 12 years now. I’d like to share some information on the use of good solid contracts when starting a vending business.

When signing up new accounts, I always use contracts to secure these accounts. I never recommend doing business on a hand shake, this can lead to problems or misunderstandings in the future.

You need to establish an understanding on prices, commissions and all other terms and conditions in the very being, so that everyone (you and your customers) understand each other and what each one can expect from the other.

The contracts I use were drawn up by Attorneys and can be used in all states. They include a section for the items being sold and the selling price of each item. They also include a section that provides the length of time the contract will be valid for.

I recommend using a contract that automatically renews for additional terms. My contracts normally run for 1 to 2 years and automatically renew at the end of that term, unless they are canceled.

Also, be sure the contracts automatically transfer to any new owners or management within the company. I always keep this clause in my contracts.

One reason for contracts is that many times companies will change ownership or management. If this happens, the company must still abide by any terms and agreements within the contract.

Contracts will stand up in court, if violated. I’ve been in a few situations were companies have tried to violate my contracts and in the end they always backed down, because they would have lost in court.

If for example, a company were to violate your contract, then you can sue for damages in court. Your contract provides you the legal right to recoup any profits that would be lost under the contract agreement.

For example, if your contract were violated and you still had 2 years remaining, then you could sue for the profits that you would loose during this 2 year time period. For good accounts, a couple of years can add up to a sizable amount very quickly.

Using contracts always provides security for you and your business. They will always provide you with a legal advantage that offers much better security than a nine to five job.
