Bankruptcy: When Debt Becomes Significant

Many consumers find themselves overwhelmed with massive amounts of debt whether it is credit card debt, a Home Mortgage or student loans. Even after investigating least intrusive options and gaining some debt advice, some people must instead resort to filing bankruptcy as the other options will not meet their needs.

There are three ways in which a consumer can be forced into bankruptcy. The first is entirely voluntary for the consumer makes the conscious decision to seek bankruptcy. The second would be involuntary where the consumer is forced by the creditor to file bankruptcy. A third manner in which a consumer may have to seek bankruptcy is by a supervisor or anyone who is part of an IVA. If you are forced into bankruptcy not by your own choice is important remember that the bankruptcy can still be filed. It is wise not to hide from the process or present obstacles. Also if a creditor claims that you owe the money that you don't it is wise to dispute the debt. It is helpful to tried to do this prior to the bankruptcy hearing.

There many negative consequences of bankruptcy. First and foremost you no longer have control over your assets. Credit is difficult to obtain. If a consumer needs credit in an amount 250 pounds, they must obtain the court's permission .Additionally a declaration of bankruptcy prevent you from holding certain public offices. These offices would include being a member of parliament, a justice of the peace or any local governmental position. Consumers typically are bankruptcy may also not practice as a chartered accountant. Persons having declared bankruptcy are also prohibited from practicing law. If you had declared bankruptcy you are not allowed to partake in a new business without prior approval from the court. Also your credit will be impaired for numerous years following the filing of the bankruptcy order.

Despite all these disadvantages many consumers find that a bankruptcy actually does provide them with some peace of mind. In some cases the bankruptcy may last for an extremely short duration even a year or less. Some consumers also like the fact that they can start again with a clean slate.
