Should I File For Personal Bankruptcy?

Bankruptcy has developed a false reputation in the past few years, and it's time to set the record straight. Bankruptcy is not a quick fix for debt, and it certainly isn't the only option out there. You should only see bankruptcy as a last resort for your financial problems because it's really never a "solution." Often times, filing for bankruptcy can actually cause more problems than it fixes, so you need to know all the facts before you make any drastic decisions.

Before you need even think about filing for bankruptcy, you should consider talking to a counselor about debt consolidation. You could potentially negotiate a away to get your debts moved into one low monthly payment. This may take a bit of time, but it will help you build back your credit, and in the end you'll feel a lot better about yourself because you put forth an effort to fix your own problems. Most lenders are willing to work out some type of negotiation because they realize that getting some portion of the payment is better than not getting anything at all. You may end up with a lower overall amount, a lower interest rate, or a lower payment to abide by. Test this out before you do anything else.

If you've gotten into too much debt to eliminate through debt consolidation, then you may be forced to file for personal bankruptcy. You have to realize that even though a lot of your debt will be removed during the process, you will still have to pay off some of the balance. Student loans or back taxes are almost alway left for you to pay because it's money owed to the government. The presiding judge may also rule some other debts to be paid off, depending on the situation. You will be forced to give up excess property to make up for parts of the balance, including extra cars or vacation homes. The judge will only leave you with the necessities.

Even though your credit cards will be wiped of their debt, you will lose the ability to getting any more cards or loans for a long time. It can take 7 to 10 years to get bankruptcy off your record, and until that time, no one is going to trust you to make payments on a loan. The government does this so that you don't have the opportunity to fall back into debt again. You'll have to make some serious sacrifices just to go through with personal bankruptcy, so try not to rush into the decision.

To actually file for personal bancruptcy, you'll need to talk to a credit counselor. The sessions will last for a couple of hours, but the counselor will walk you through what you need and what you can expect to lose. You will go through this after the bankruptcy process is complete to ensure that you will maintain a budget and bills for the rest of your life. You will have to go through courses to get you on the right track. It's a long and tough road, and it's certainly not for everyone. Bankruptcy is not something to be taken lightly, so before you think everything through before you start.
