Delaware School Settles Asbestos Violations

Submitted by justice
Thu, 2 Apr 2009

According to reports, the U.S. Environmental Protection Agency recently reached a settlement with a charter high school in Delaware regarding asbestos violations.

Pencader Business & Finance Charter High School reportedly violated the Asbestos Hazards Emergency Response Act (AHERA).
School Under Fire for AHERA Violations

AHERA is a federal law that requires schools to inspect and properly manage asbestos containing materials.

A properly implemented management plan helps to prevent asbestos exposure by ensuring maintenance and activities at school won’t disturb the material.
Asbestos Violations Cited

According to EPA officials, a recent inspection at the school found that it was in violation of the following:

* Failure to conduct initial inspections to identify friable and non-friable asbestos materials in the building
* Failure to develop and submit a management plan for the asbestos issues at the school
* Failure to notify parents, teachers and students of the dangers of asbestos and its presence at the school

In the settlement, Pencader was asked to pay a $2,421 penalty for the above violations.

Asbestos is a known carcinogen that can lead to the development of mesothelioma cancer and other fatal illnesses if ingested or inhaled.
