Accidents on Holiday

Submitted by David Salt
Fri, 30 Oct 2009

So, you've decided to take a holiday. You visualize the perfect and relaxing holiday and look forward to the day when you depart. While most holidays can go off without major hitches, occasionally some holidays experience disappointing problems. Holiday complaints are probably the last thing on your mind at this point however, while on holiday some people may find themselves involved in accidents. Many people are not aware that if this accident was not due to any fault of yours, that you may be able to file a personal injury claim.

Depending upon your holiday location, the manner in which your claim will be handled can vary. If your injury were to occur while on holiday at some venue within the United Kingdom, the usual rules of personal injury claims would be applicable. In locations outside the United Kingdom, this can vary considerably. However, there are some other guidelines that can allow you to seek the services of a personal injury solicitor within the UK even if your destination was outside of the country. One of these occurs if your holiday was booked as part of a package through a travel agency doing business in the United Kingdom. The claim can be made against the travel agent or anyone representing them. These representatives could include hotel staff. As long as the injury occurs from something that is part of the specific package for which you purchased from the travel agency, then the claim can be filed against the agent. On the other hand, if the injury occurs while touring the location or at other facilities not paid for as part of the holiday, then you could not file a claim against the agent. That claim would have to be made with the local agencies within the location.

About the Author

In order for your holiday accident claim to be successful, you must provide proof that someone else was responsible for your injury. All information should be clearly reported and be extremely accurate. If you have a camera available, it would be prudent to take photographs as they could provide evidence. Also, it is suggested that you record the names of any staff involved in the situation. This can be helpful later on down the road once you file your claim for the accident abroad.
