Ease with Collaborative Laws

Collaborative law is a dispute resolution process that does not involve the courts. It is a process that is based on facilitative principles, such as mediation, but is distinct from mediation in that the parties are represented by their own attorneys who facilitate the discussion in accordance with an agreement. Collaborative law has gained popularity particularly in the divorce context, where the process is known as collaborative divorce.
They say that there is a bit of similarity between collaborative law and mediation, in that both are facilitative processes. However, in collaborative law, the parties are fully informed about the law and the consequences of various options, and their advocates facilitate the negotiations. In mediation, the mediator is a neutral third party who doesn't represent or advise either side.
In a collaborative divorce, the parties strive to reach a fair settlement through a series of meetings between the two parties and their lawyers, and sometimes other neutral experts.
