Marriage and making a WillSubmitted by markhincks@live.com Fri, 12 Jun 2009
Making a will enables you to create a list of instructions telling your Executors what to do with your property when you die.
Married couples, who are making a will, both need to do so. A pair of similar wills are called 'mirror wills'. Getting married or remarried cancels a previous will unless it expressly states otherwise. In England, Wales and Northern Ireland, your Will is cancelled automatically if you get married or enter into a civil partnership after you have signed it unless the Will contained a sentence stating otherwise, for example if it had been drawn up just prior to you getting married. If you get divorced or your civil partnership in annulled after you have made it, any gifts in favour of your wife, husband or partner will be cancelled (unless the Will states otherwise) and therefore your Will would be read as if they had already died. It is essential that you consider making a will again if there are major changes to your circumstances. When making a will, most people want to ensure that control of their assets stay within their family or group of close friends so these same people can also be your Executors i.e. family, friends, spouses and children etc. You need a minimum of 1 and maximum of 4, if there's anything complex in your Will, you should consider using a professional to act as Executor, such as a solicitor. When making a will many people appoint a solicitor alongside a friend or relative. This enables the burden of the work to be shared with a professional who can advise. It also ensures that, if the executor is unable to carry out their duties for any reason, there is the support that is needed. A Solicitor will charge for their advice and work and their fees will come out of your Estate.
I have a blog which highlights the importance of Will writing and covers the reasons as to why one should write a will. It was stated that over 70% of the UK population do not have a Will, therefore i set out to create a source of information online to assist those that do not have a Will and point the reasons as to why you should write a Will.
