A fiancé visa is the one issued to the fiancé of a US citizen to enter the United States of America. Fiancé, according to the law, is a person who is going to get married on engaged to an American Citizen .Usually, there must have been at least one meeting between the two persons. Fortunately, the Department of Homeland Security's U.S. Citizenship and Immigration Services laid down some exceptional rules because it is not always possible to have a meeting due to several reasons. A person can also be referred to as fiancé even if a contract is concluded. This is the case wherein the man and woman have not met and the marriage is not consummated by them.
A fiancé visa can let the fiancé of the US citizen to travel all the way to the States. The fiancé and the citizen can marry and live together in US if a petition for alien finance is filed by the US citizen with the department of Homeland Security's USCIS (United Sates Citizenship and Immigration Services) associated with the place where the American citizen lives in. This cannot be filed in any other immigration office that is located abroad.
To file a petition certain conditions have to be met
->It is mandatory for the person petitioning to be a US citizen
->Within 90 days, the fiancé must be able to enter the states and marry the citizen
One the petition is filed, it is sent to National Visa Center for further processing and finally, it is sent to the consulate where the fiancé applies for a K-1 nonimmigrant visa or fiancé visa. The petition is valid for 4 months and this can be extended by the Consular officer once it is expired.
All the below mentioned documents must be available with the fiancé while applying for a visa
• A passport that validates the entry of the fiancé to the USA that has a validity period that is at least 6 months greater than the period of stay. However, there are some exceptions that are country specific
• Death Certificate or Divorce certificate citizen of the previous spouse, if any.
• Police certificates from all the locations of stay since the age of 16
• Medical certificates
• Financial Evidence
• Nonimmigrant visa applications (2)- Form DS 156
• One fiancé visa application (1)- Form DS 156k
• Evidence of Relationship
• Fee payment
There might be additional documents required that depends on the situation and the country. The requirements will be clearly mentioned by the officer. If the documents are in foreign languages, they must be translated to English. Original documents will be returned after processing is done. It is recommended to take clear photocopies of all the important certificates to the interview. The applicant must have enough money which will be required at several points like medical tests, finger printing, photocopying, Fiancé application fee and status update.
Once the visa is obtained, the officer provides all the information related to the travel date and conditions. After marriage, I-486 form must be filled by the fiancé to update the status.
Note:
Miami Fiancé Visa can let a person to enter the states only once. The same visa may not be used for re-entry. Incase, if the fiancé wants to leave and re-enter, Form I-131 must be filled and entry can be made only after the application is processed by the authorities.
