Birth injuries are so very difficult to deal with for both the infant and the mother of the little child. Some birth injuries are of no fault of the doctor or the mother, and are unfortunate things that do occur from time to time. Other times, it is because of the mother's small pelvis or because the labour was unusually long. In addition, some women that have had multiple births have a slightly increased risk for birth injuries. Some birth injuries however, are caused by doctor or nurse error. When a brain or head injury is caused by the medical staff is when the dynamic chances. The hospital, lab, or medical centre could be at fault, and could have to pay. Whether they have to pay and how much depends on the evidence and the medical records.

When a mother or a family decides to take action, often times it will be in the form of suing the doctor, the hospital, or some similar combination. At that point, the process of collecting information begins. The family will want to know what the correct procedures are, were they followed corrected, and if they were not followed correctly, why weren't they? The family's lawyer will request some information regarding the circumstances of the birth injury. The hospital will also request some information so they can see what their rights are. They will also want medical information, financial records, and other important information. At this point, many cases will get settled out of court before they go to trial, for a number of reasons. One of those reasons is that the hospital or the doctor doesn't want the bad press coverage that comes with a messy lawsuit. They would rather make it go away quickly, especially if they know they are likely to lose the case if it will go to trial. Also, the family often doesn't want to go to trial, because it is painful to go through a lawsuit in court. If both sides do settle, often times the sides are not allowed to speak publicly about the terms of the settlement or the amount of money that switched hands.
