Compensation Claims and the Shy Client

Submitted by David Salt

Are you the type of individual that doesn't like to draw attention to
yourself, yet has been in what could be a personal injury case? You know
the type of person, retiring, never wanting to be in the centre of
attention, and suffers in silence? If you have sustained or been injured,
you owe it to yourself and your caregivers to consult with a solicitor and
see if you have a personal injury case. If your life has been impacted
such that you can no longer work at what you used to do with any degree of
comfort, or at all, or you have hurt yourself on the job, denying your
injury will do you no good. Your life has been changed, and it really is
the better thing to do to recognise it and deal with it.

There are many examples in the law of cases like this. People in the home health profession are
particularly at risk. Many aides are injured, for example, caring for the
sick or elderly, without proper training in how to move them. Even an
elderly person may weigh more than an untrained person can handle, and so
in trying to help them, the caregiver actually pulls out their back, or
hurts themselves. The private sector is rife with cases of people not
wearing weight belts or using mechanical lifts where available.

Another scenario of the shy client is where children are involved. After
an accident, parents or guardian must make sure the child feels free to
speak exactly what they are experiencing. Many children will clam up, or
not speak about injuries or hurting for fear of not being considered tough
(especially teens). If children have been involved, it is always best
measure to get them to hospital whether they think they need it or not in
order to do a baseline. Sometimes the full effects of accidents don't show
up for days.

Some people are just afraid of consulting a solicitor. The idea of
explaining themselves to a stranger somehow runs against their grain. This
is an attitude found in many older individuals, who have been through
rough patches in their lives, and think somehow "this too shall pass". In
many cases, it doesn't. Family members should guide the individuals into
meeting with solicitors who can at least assess their cases and tell them
they can file a claim.

In no case should being a shy client prevent a person from filing, because
personal injury is life changing and needs to be addressed. Winning a
claim can make their lives much better and while not restoring to them
that which was lost, it can certainly add to the comfort level of the here
and now.
