Crash Victim Files Accident Claim Against Repair Shop

Joshua Hargis has launched a claim against the company that installed a new rear tyre on his motorbike, saying they were negligent, resulting in him being involved in a serious accident on the road.

He was driving his motorbike at high speeds along a main road when he lost control and skidded off the road, landing underneath his bike at the side of the road. Luckily no other vehicles were involved, which could have made the accident fatal.

He claims his motorbike had recently been into the garage for servicing, where they installed a new rear tyre after which they deemed the motorbike roadworthy.

He says that the garage failed to fulfil their duty of care to it’s customers by installing the rear tyre without aligning the rear wheel axle in the swing arm of the motorcycle.

In addition, he says that they acted negligently in failing to align the axle adjustment bolts. After completing the repairs they neglected to carry out a detailed inspection of the repairs they had just carried out.

Before returning the bike to him they also did not take it for a test drive to ensure that it was roadworthy and safe to be returned to Mr Hargis.

Mr Hargis sustained severe and permanent injuries to his head, torso and limbs which caused and continues to cause pain, suffering, disability, disfigurement, medical expenses and lost wages as a result of the accident.

He is seeking a large cash settlement from the garage which he deems responsible for his devastating injuries.
