How no win no fee services work

Most of us have at least heard of “no win no fee” legal services but not everyone understands how they work. We all know that taking legal action in a compensation claim is often quite frustrating and very costly as well. In such instances, the no win no fee service can be a valuable weapon that helps you win the case and save money at the same time.

So how does such a service actually work? The answer relates to a principle of English law stating that the loser of a case must not only pay their own legal fees, but the costs for the winner as well. In the no win no fee scenario, the attorney or solicitor agrees not to charge the client any fees unless they win the case. So when relying on a such a service, you essentially have the chance of cutting costs from the other side entirely while being able to pay the solicitor at a later time.

One way to cover a no win no fee service is taking out insurance. This simply means that the solicitor takes a significant risk yet charges a fee for successfully representing you. The level of risk involved usually determines the amount of the success fee. If the fee is reasonable, the court will order the loser to pay it in accordance to the settlement. The most common type of insurance you can depend on to cover your court costs is ATE (after the event). You would take out ATE insurance after the event has occurred and you know the case is going to court, covering both sides of the costs if you happen to lose.
