Personal injury (PI) claims constitute an ever growing area of legal claims. This is partly due to marketing; particularly advertisements on day time television, which are aimed at those who have perhaps had to give up work due to injury. It is also partly due to more people recognising that an injury which they have sustained was not their fault and there may be a way to recoup losses.
There are a number of categories under which claims can be made, but broadly speaking they fall into two categories. Firstly, there are "general damages" which includes pain and suffering, and secondly there are "special damages" which relate to your inability to continue in your chosen line of work. The court's award for general damages is based on subjective opinion. That is, it depends on what the judge thinks of your injuries. The claimant will need to prove his pain. No award will be granted if claimants cannot prove their pain. The state will sometimes pay compensation for injury, however, in these cases the injury has to be serious. For minor injuries or injuries which may not be considered serious, you are entitled to make a claim for compensation if the accident which caused your injury was not your fault. Special damages are easier for a court to quantify. This is because they assume that your job defines your life. So, if you are a motor cycle despatch rider and an injury means you cannot ride a motorbike again it is possible for them to calculate estimated financial losses. Making a personal injury claim can be a complex process, however there are reputable compensation solicitors who can handle a personal injury claim for you and significantly reduce the amount of stress you would expect during such a process.
