Some Vital Information As Regards Acquiring Criminal Pardon in Canada

Submitted by Lawrence Ocampo

The National Parole Board of Canada (NPBC, for pardons Canada) lets those who have been convicted of a felony to delete their criminal file from federal databases. This course of action is termed a pardon. It ‘veils' an individual's criminal documentation, and is an acknowledgement from the NPBC that a person has been reformed and is leading a crime-free way of life.

There are several benefits linked with getting a criminal pardon. The apparent benefits include: marketability in the labor force; safeguard from discrimination that is normally associated with applying for a job; and the ability to engage in activities that previously restricted an individual as a consequence of their criminal record (e.g. volunteering, education, child custody, adopting, and so forth). Further benefits include taking away of stigma, an increase in poise, and the calmness that you are no longer a prisoner to your past.

Here are some key facts about criminal records and pardons: criminal file checks are conventional practice by employers. Countless employers have inequitable hiring guidelines with regards to individuals who have criminal documentations; anyone sentenced of a crime has a criminal record; an official request must be made consistent with the Criminal Records Act of Canada to have a documentation eradicated from the federal database; Once a pardon is authorized, the criminal file is ‘secreted' from the public. Employers will be unacquainted of a criminal documentation when consulting federal databases.

The National Parole Board of Canada compels individuals to have fulfilled certain conditions before submission of an application. The first condition is that an individual has completed their prison term(s), and the second prerequisite is that the suitable waiting period has been observed following completion of the sentence(s). Concerning the first requisite, sentence completion, here are the conditions which should be met: penalties, costs, restitution and compensation orders, and surcharges have been paid; the person has completed their time as discussed in their verdict; and the individual has finished the probation order acceptably. For the second requisite, waiting period after prison term completion, consistent with the Canadian Criminal Code and further federal statutes, summary convictions entail a 3 year waiting interlude while indictable guilty verdicts require a 5 year waiting stage.

If you think you are not qualified, contact Canadian Criminal Pardon Services (CCPS, Toronto pardon). Several parts of your file can be initiated early and this will significantly trim down the amount of time you will have to wait for a Pardon. If your file is compiled early, they will be able to submit it the moment you are qualified.

CCPS takes a hands-on attitude in initiating your Pardon file submission. They know the value of time and the critical importance attached to acquiring a Pardon as early as achievable. Immediately after you have provided them consent to act on your behalf, CCPS will take the needed steps to ensure all your documents are prepared and meet the prerequisites of the National Parole Board of Canada. CCPS will get in touch with all relevant courts, police agencies, and other government units - depending on your case - to make certain that your file is collected appropriately.
