Divorce or the divorce law is a law that signifies the ending of a marriage even before the death of either spouse. It is the law in which married couples usually follow when a marriage has become so difficult that separation is the only solution.
Divorces and Annulments work in the same way when ending a marriage, the only difference between an annulment and a divorce is that annulments are a legal procedure for declaring a marriage null and void. Unlike divorce, it is retroactive: an annulled marriage is considered never to have existed.
In divorce, spouses often disagree about the terms of the divorce, which can lead to stressful and expensive litigation. Less adversarial approaches to divorce settlements have recently emerged, such as mediation and collaborative divorce, which negotiate mutually acceptable resolution to conflicts.
There is a parallel between collaborative law and mediation, in that both are facilitative processes. However, in collaborative law, the parties are fully informed about the law and the consequences of various options, and their advocates facilitate the negotiations.
