The Many Faces of Clinical NegligenceSubmitted by David Salt Thu, 27 Aug 2009
There are a number of many different types of clinical negligence where a claim can be made due to a lack of care and focus made by a medical professional. Clinical negligence claims can be made for a number of reasons and each case can be split on the basis or area in which the negligence took place. Patients can claim for clinical negligence based the fact that they have been left impaired, uncomfortable or generally worse off due to a medical professionals inaccurate practise of medicine on your health. Clinical negligence is much the same as medical negligence however it includes dentistry negligence, another form of health care. Clinical negligence claims can made based on nurses negligence, Ambulance negligence, dentist negligence, doctors negligence and birth injury claim.
There are many reported incidents of birth injury claims, one particular story that can been found on the internet introduces a young girl named Kayla, who is a prime example of the effects and results that have lead from a birth that was not properly assessed and practised to the highest and safest standard. Kayla was effectively starved of oxygen during her birth because the nurses and doctors made a mistake by not delivering her earlier on in the labour process. This effectively left Kayla with a number of disability's and health issues that will continue on into her adult life. Kayla's family immediately contacted a solicitor's firm and made a clinical negligence claim for compensation which they then effectively won. This compensation helped Kayla's family afford the further care that would help her to live a fairly normal life. This care included the relevant medical equipment that would ensure that Kayla could live comfortably. The compensation also helped afford some home help for Kayla's family to help look after Kayla and her condition, whilst also providing an extension to there house which would provide accommodation for the carer. This is just one case of a birth injury claim that resulted from clinical negligence. It is only right that if someone's health is damaged due to clinical negligence then the family involved should be provided with sufficient money to help provide the essential equipment and medication to help that patient live a normal life.
