<description><![CDATA[ California Overtime under California law is awarded to an employee when an employee works over eight hours in a day. When this happens the worker must get time and half over what the employer normally will pay. If the worker works 12 hours a day he or she is entitled two times the rate of pay.  This doesn't just reflect in the amounts of hours in the day but also if the employee works more then 40 hours a week for seven consecutive days. When this happens the employee is entitled time and half as well.<br> <br>Employers sometimes fail to pay for these extra wages for two reasons. The first one of course is economics. Employers will rather label someone as a salary employee. It is cheaper for an employer to pay a person straight wages then to pay all these overtime wages. Though, if an employee makes a claim the employer could be faced with the problem of paying the employee OT wages, penalties, interest and all this could be very costly. <br> <br>The second reason employers fail to pay for the OT is a misunderstanding of the law. Most employers feel that if they give an employee a title as manager or supervisor that the employee then would be exempt from getting the overtime wages that come with working extra hours. But the problem with that thinking is that the title doesn't neccessarily make them exempt form overtime but the duties that they do determines whether their exempt.<br> <br>When an employer is taken to task on the overtime issue and has misclassified the employee, a good labor law attorney will investigate the claim. <description><![CDATA[ Even though you may be surprised to hear this but there are really no U. S. Labor laws of any kind to which mandates how an employer must treat you as a person. In other words there are no laws in saying that an employer cannot be a jerk towards you, in which it will keep a bad boss from making your life miserable by going to work every day. So, in case you wonder, yes even those jerky bosses are entitled to their rights. After all, we live in a democracy in which government regulation is discouraged and employment is at will.<br><br>There are laws set up for overtime pay and minimum wage. But there are no labor laws that tells an employer how much to pay an employee. Also, most benefits are not mandated by labor laws. This includes severance pay, sick leave, and vacation pay. To your surprise your employer even has the right to spy on you without your knowledge, make you take a drug test and unfairly terminate your employment just to name a few. You may think you are getting the wrong end of the stick but it may not be illegal for your employer, even though you may think otherwise.<br>The good news though is that there are a handful of labor laws that do generally protect U.S. workers.  Most employers will adhere to these basic laws, because if they don't they very well could end up in court.<br><br>But that's generally is at the HR and legal department levels, where the employees are properly trained in such matters. Companies are also made up of other employees, who might not have heard of labor laws or fully understand their significance. That is why HR and legal departments should properly train those in control like that boss is a jerk. Another big problem that goes on is that the HR and legal departments are unlikely to admit that an employee complaints and accusations have little or no merit, and the company is liable. The worst thing about this is that the perpetrators are more protected then the victims.<br><br>You may feel like you are getting a raw deal, but just showing your employer the appropriate labor law if there is one might not mean a thing. <description><![CDATA[ The federal Fair Labor Standard Acts requires employers to pay their employees time and half their regular hourly rate of pay when the employees work more then 40 hours in a week. This includes employees who work forced overtime or employees who worked off the clock. The employer should know that covered employees that work more then 40 hours a week should be paid overtime. Many employers wrongly believe that paying their employees a salary wage will exempt them from the Fair Labor Standards Act. Even if a covered employee received a salary, unless that employee is actually performing certain types of specified job duties, they will be entitled to receive overtime. <br><br>The Fair Labor Standards Act is a national law and therefore, is applied to all the states. <br>Overtime and the minimum wage must be honored by all employers who are covered by the Fair Labor Standard Acts. <br><br>Many employers try to get away with this because they feel like it is too expensive. Luckily, employees have right under the FLSA to file an overtime lawsuit or other wage claim when they are denied these privileges. <br><br>The United States Department of Labor (DOL) enforces the federal minimum wage and overtime law. DOL sometimes is not much help at all only because they are understaff and usually have too many complaints and not enough investigators to look into all the complaints. The government set up this act so that workers rights were protected and by doing this it created fair play between management and labor. This insured that there would be a minimum wage.  This meant that management could not pay their employees below what the government instituted. It also created overtime pay in which management had to pay extra if employees worked over an eight hour shift or over 40 hours a week. It also installed regulations for minors in the workplace. <br> <br>Special considerations were giving to various groups such as children working on a farm for an example. This is because of the diverse nature of the American workforce. People who worked in executive and administrative position were giving selected terms. As well as thousands of other special cases who are able to claim exemptions to The Fair Labor Standards Act regulations.<br> <br>The most important change to come about occurs in August 2004 when the Fair Labor Standards Act came about. To be able to establish which jobs is exempt form overtime and which jobs are not lawmakers decided to amend the document. With this act many Americans who had the status for overtime pay had now been reclassified into administrative, professional, and executive categories which in turn disqualified them for their overtime pay.<br> <br>For the most part Americans work hard at their jobs and try to put in an honest day's work for an honest day's pay so they deserve respect for the contributions they make to a company. Therefore, they should be entitled to fair compensation for their performance.
