Black jets and black boats, and even a black helicopter to whisk the fair maiden off to a life of leisure.  The makers of the commercial for the Black Card knew exactly what they were doing; these visions of wealth and relaxation appeal to most people, and more than would care to admit it appreciate and desire status and prestige.<br /><br />How did the black card come about, exactly?  Well, the original black card was the AMEX Centurion, which was virtually unknown by the general public, and available to even the rich only by invitation.  It could literally purchase anything the card-holder desired, and there were outlandish reports of magnificent and quixotic purchases made.  The AMEX still exists today, and has such requirements as an annual expenditure of $250,000 before an invitation is forthcoming from American Express, as well as a $10,000 activation fee, with a $2500 annual fee thereafter.  Clearly, this is the kind of true black card that Maybach owners use.<br /><br />The Visa Black is Advertising 101; it capitalizes on the mystique and prestige of the AMEX, offering luxury, although nowhere near the same level as the Black Card.  Generally, the Black Visa is intended for those who spend between $50,000 and $150,000 per year on credit, which comes out to around 1% of Americans. <title>U.S. Supreme Court Rules Credit Repair Firms Can Force Arbitration</title>

Justices rule that <b>credit repair</b> firms can block lawsuits if customers' agreements carry arbitration clauses. The ruling is the latest in a string to back such clauses over consumers' right to sue.

A 1996 law sought to protect struggling consumers from businesses promising to improve their credit rating, and specifically gave customers the right to sue any firm in violation.






But the U.S. Supreme Court ruled Tuesday that <a href="http://www.creditrestoreusa.com"><i>credit repair</i></a> companies could block such lawsuits and instead force disgruntled customers into binding arbitration if they had agreed to such a provision in the fine print of their agreements.






The 8-1 decision is another in a string of high court rulings in recent years that have backed an arbitration clause over a customer's right to file a lawsuit.






The trend alarms some consumer advocates, who complained that arbitration proceedings typically favor companies and remove the strong deterrent of class-action lawsuits.






"This Supreme Court is just steam-rolling over the American civil justice system and throwing consumers to the wolves," said Doug Heller, executive director of Consumer Watchdog, an education and advocacy group.






But Stanford Law professor Michael W. McConnell, who represented the credit card company and a bank involved in the case, said that just because arbitration is good for a company doesn't mean it's bad for a consumer.






Arbitration can be "a fast, cheap, easy, convenient way of resolving small disputes" with companies, McConnell said. And Tuesday's decision further enhances its use by re-emphasizing the high court's view that the right to sue doesn't specifically prohibit arbitration requirements.






The latest case involved three San Francisco Bay Area consumers who received credit cards marketed by CompuCredit Corp. of Atlanta and issued by Columbus Bank &#038; Trust, now a division of Synovus Financial Corp. in Columbus, Ga.






The Aspire Visa card was targeted at people with poor credit scores as a way to help them rebuild their credit history. The Aspire's promotional materials said it came with a $300 credit line. It also did not require a deposit, unlike many cards offered to people with low credit scores.






But the consumers said hidden costs ate away almost all of that credit line. They included a $29 initial finance fee, a $6.50 monthly fee and an annual fee of $150. The total fees for a year were $257. The fees were buried in the small print of the credit card agreement, where it was also stipulated that either the customer or the company had the right to force a dispute into binding arbitration.






The consumers filed a class-action suit alleging CompuCredit and Columbus Bank violated the <u>Credit Repair</u> Organizations Act, which prohibits companies from engaging in deceptive practices and requiring advance payments for such services.






The U.S. District Court in Oakland said arbitration did not satisfy the law's provision of a right to sue. The U.S. 9th Circuit Court of Appeals in San Francisco upheld that ruling.






In overturning those decisions, the Supreme Court relied in part on a high-profile case last year that upheld AT&#038;T Mobility's binding arbitration clauses that prohibited customers from filing class-action lawsuits.






Justice Antonin Scalia, writing for the majority, said that if Congress had intended to prohibit binding arbitration in the consumer credit protection law, it would have specifically done so, rather than implying it in a right-to-sue provision.






"At the time of the CROA's enactment in 1996, arbitration clauses such as the one at issue were no rarity in consumer contracts generally, or in financial services contracts in particular," Scalia wrote. "Had Congress meant to prohibit these very common provisions in the CROA, it would have done so in a manner less obtuse than what respondents suggest."






Because the law was silent on whether claims could go to arbitration, he reasoned, CompuCredit was allowed to force such claims into arbitration under the Federal Arbitration Act.






Justice Ruth Bader Ginsburg, the only dissenter, said the specific right-to-sue wording in the law could not be satisfied by arbitration. She criticized the majority for taking too legalistic an approach in interpreting a law designed for consumers.






She said the finding that the right to sue "merely connotes the vindication of legal rights, whether in court or before an arbitrator," might make sense to someone who was "trained to 'think like a lawyer.'"






"But Congress enacted the CROA with vulnerable consumers in mind — consumers likely to read the words 'right to sue' to mean the right to litigate in court, not the obligation to submit disputes to binding arbitration," she wrote.






Paul F. Kirgis, a law professor at St. John's University in New York, said the court's decision was expected given its past rulings on arbitration. Tuesday's ruling strengthens a legal shield for companies against class-action suits.






"For an individual consumer, going to a state Small Claims Court is not really a more palatable option than arbitration in most cases," Kirgis said.






"The real risk," he said, "is that companies will engage in small-scale frauds committed against large numbers of people without the fear of class-action as a deterrent."

There are many <strong>credit repair</strong> myths out there and the purpose of this article is to clear some of the most popular ones up and give our readers some valuable information. There are several outrageous claims being made all over the Internet by companies that pop up with one goal; to collect as much money as possible from unsuspecting and desperate people. Individuals with bad credit are so desperate to improve it that sometimes they believe these false statements in hope that they are real. Now on to the many <span style="text-decoration: underline;">credit repair</span> myths. First off, there is no 7-day or 15-day credit repair. It does not exist. There are so many crazy claims from companies claiming the ability to remove all negative information in a matter of days. During legitimate credit repair you will see results in approximately 30-35 days. The credit bureaus have 30 days to respond by law. This is something that will save you from being ripped off; just know that any company claiming they can get results any sooner is not one to trust.






Something else that is seen often is the famous, "I have a friend on the inside" or, "My uncle works for the credit bureaus." Again, complete lies. This is just a tactic used to swindle money out of you. No legitimate credit repair company is using "inside connections." If you hear this then do yourself a favor and run away form that company. The only thing that will result from that is a loss of money from you and zero progress on your credit repair. Save yourself the trouble, and make sure that you only deal with a legal credit repair company. Results do not happen overnight and there sure isn't a magic wand to instantly make negative information go away. Use common sense. If it sounds too good to be true, then it usually is!






Another often advertised method is the so-called new credit profile. These are usually referred to as a CPN (credit profile number), SCN (secondary credit number), or EIN (employer identification number). The way in which they advertise the use of these is illegal and can land you in extreme trouble. These credit repair hack shops will tell you to use this false number to attempt to acquire new credit with. Again, it will not work and you will find out you were ripped off. The FTC warns about this increasingly popular scam, and more information can be found on their website. Some companies ever claim they can obtain you a new social security number. Do not fall for any of these claims as they are false and if you do apply for new credit fraudulently it can come back to haunt you.

Now I enjoy statistics as much as the next person and I remember what a mentor, who was a doctor, told use, "90 % of all statistics are made up, including this one."






Normally the ones that are sticklers and won't make a move until they get the scientific data that self healing works are the ones that it works less effectively with. Since changing your mind is part of the self healing process it is a little more difficult if someone says I want scientific proof. You can give it and they can respond that doesn't prove anything even though you just did.

She goes on to list 20 health conditions that self healing is good for and 20 health conditions less open to self healing and she then writes...

As I said, data is limited for many of these conditions, so if you believe you can change your body by changing your mind, more power to you! The way I see it, the more tools you have in your healing toolbox, the more likely you are to achieve complete cure.</span>

The one thing I do appreciate about Dr. Rankin's thoughts is her openness to using whatever gets results for people. It is not an either/or mindset. It is a mindset that includes, which is different from the mindset that is set on only wanting <strong>scientific data that self healing works</strong>.

Alcohol-free red wine does not reduce blood stress, and contained in wine polyphenolic flavonoids do not eliminate the hypertensive effect of alcohol.
