Should Divorce Laws Be Made More Lenient?

However, the cumbersome divorce laws pose a huge barrier to gaining a quick divorce.

Current divorce laws can make divorce a long and painful process. Traditionally, the idea of lifelong marriages had gained widespread acceptance. However, with your changing lifestyle, needs, and expectations, not every marriage can survive a lifetime. Life expectancy of people has increased and most of the people want to have a second chance at love without having to stay in a loveless marriage.

The courtroom battles can be very time consuming and the never-ending visits to the lawyer’s office can be frustrating. When people want to opt out of marriage, they need a fast way to end their pain and misery. At such a time, if we expect people to gain evidence of marriage failure, prove it in endless court meetings, and wait for months and months before any relief can be experienced, it would be extremely unfair. Therefore, it is imperative that the divorce laws be made easier.

Divorce Laws Should be Made Easier

Divorce laws should be made easier to lessen the mental and physical pain associated with a lengthy divorce process. The following arguments will illustrate why simplifying the divorce procedure will help the couples as well as other people affected by the divorce.

  • Separating Partners Will Separate With Dignity

    It is very common to see a husband and wife behaving like perfect enemies in and out of court. The constant fights, bickering, insults, and threats that couples engage in can create huge problems in not only reaching a viable financial settlement but also ruins any chances of maintaining healthy relations post divorce. This can have negative consequences if the couple has children.

    The animosity and the bitterness during long courtroom battles can create permanent rift between the parents and this is bound to have an adverse effect on the upbringing of the child. The parenting decisions are bound to be clouded by bitterness associated with divorce and the innocent child will be made to suffer.


  • Healthier Environment for the Children

    Is it better for a child to stay in a home where there are constant fights and unhappy parents or is it better for a child to see parents that are happy with their respective lives? The longer the divorce process takes, the longer the child is exposed to unhealthy situations at home. It is very natural for couples to fight and vent out their anger at each other when a marriage ends. However, this phase does not have to last for long.

    Since the current divorce laws take so long for the divorce to actually materialise, the couples continue living in the frustrating pre-divorce phase. Seeing the parents unhappy and constantly at war with each other can make the child feel very confused and scared.

    This sort of an environment can adversely affect the child’s mental as well as physical well being. If the divorce laws are relaxed, the couples will move on with their new lives much faster and the children can have access to a healthy support system during this time of crisis.


  • Expensive Solicitors Have to be Hired

    The current divorce laws make divorce a very long process. The divorce case can continue for several months in most cases. Expensive solicitors have to be hired and they have to be paid for each court hearing, meeting, and other activities such as filing and mailing important documents related to divorce.

    As the divorce process stretches, the animosity between the couples may also increase. This can give rise to unhealthy arguments and complicate the financial settlement and other important issues such as child custody. During all of this, the only person who stands to gain is the solicitor. If the divorce laws were to be relaxed, the number of court proceedings, issues between couples, and paper work will reduce, which will thereby reduce the cost of hiring solicitors.


  • Reduce Chances of Adultery

    When our laws force two people to stay together or two people are stuck amidst the lengthy divorce procedure, they are bound to go astray during their marriage or during the time of the divorce. Adultery can create numerous problems between the couple, even if it is committed during the time of the divorce. If the divorce laws are relaxed, the rate of adultery can be significantly reduced.
